Not necessarily. Civil proceedings can and do have different outcomes.

Just get a lawyer that only takes a percentage of the settlement for his payment.

Gives 'em an incentive to win.

Very difficult to do these days. They wont take the case unless the other side has lots of

money and you have a case. Even then, you have to pay for expenses, like deposions (stenographers), which can cost $1,500 a day. Been there done that.

More on this. The other times she accused me, my father told the police that I in fact did not hit her. She got smart and told him to back her up or she would leave him. So they both told the police that I hit her. Even without evidence, I assumed that the word of 2 people (her and a supposed witness) was enough. Am I wrong here? You are right though, there was no physical evidence and the supposed events took place months before hand.

If I am missing so much as a shoelace I will charge both of them with larceny. I do suspect that some of my more valuable items such as my new computer and my mothers jewelry that she left me when she died are gone. When I can prove that, I will swear out complaints.

Don't forget, you get witnesses also. They would also need doctor bills for any damages. They will only be awarded mental damage if they can prove physical damage. If your lawyer is any good, he/she should be able to discredit them and show that they are drug addicts and liers. Your lawyer should be able to dig up their records.

Right, and since they don't have money, i probably wouldn't waste my time and resources. But if I do have a case against the state, then I am sure the lawyers would be lining up to take that one.

yep, but you would then look at as a retirement plan. it would take years to get that one through the system.

So, I have posted my situation on 3 - 4 different legal websites. Here is the first reply I got:

If you have already done twenty days in jail and you have a clean record they'll probably let you off for credit for time served (talk to your PD about this). Of course if they don't and you lose the criminal case at least you'll have a place to stay.

This guy is a criminal defense lawyer too. What a douche bag. Guess he thinks he is funny.

Lawyers and doctors are exposed to peoples misery on a daily basis. This seems to desensitize them to suffering in general, some more than others.
