Here is how to Help Tommy

Just talked with Tommy on the phone. I am proud to hear what all of you have done to help out Tommy so far. It makes me PROUD to be a member of this community! We need to keep it up cause he is not out of the woods just yet. Not by a long shot.

Ok can someone write this up a little better so we can link to it and give people a better idea of whats happened and why he needs the money !!!

I thought about it and decided that it is only right to explain to everybody what actually happened.

A few months ago through a bizarre turn of events my father, his new wife, and I all ended up living together at my place here.

Well, my fathers wife is mentally ill and does not take her medications (2 different anti-psychotics and 1 anti-depressant). She decided that she did not like me so she called the police and told them that I hit her. The first 2 times she called, the police did nothing as they understood what was going on. She got smarter and called the county sherrifs department and they did arrest me for 1 count of traspassing (where I have proof of residence) and 2 counts of assault on a female.

I was arrested, and due to the nature of the jail system, could not get out as it is almost impossible to get any type of message to the outside world.

With the help of another person locked up who had his girlfriend contact DOU, I was finally bailed out, but not until after I spent 3 weeks in jail.

As it stands now, there is a restraining order out on me (domestic violence order) so I cannot go home. I am in a hotel now but will be homeless in a few days since the money will be running out. In addition, I am going on trial next Tuesday for the charges against me, and could for the first time in my life obtain a criminal record. If convicted there is a chance could do prison time due to the nature of the charges (although more likely not, depends on the mood of the judge I guess).

The scariest part is that I never laid a hand on her and I could be convicted of violent crimes.

I was self employeed, so without the ability to get my materials from my home, I cannot earn a living.

To make matters all the worse, I have not seen my dog in a month and do not know if he is even still alive. He has diabetes and needs daily care, something 2 alcoholics on coke may not give him. He was my #1 and I miss him very much.

So, that in a nutshell is what happened to me. Any questions?

I wish your trouble will end as soon as possible because I know how much these kind of things are attacking the nerves.

I hope you'll be strong facing to these problems and I'm really sad I couldn't help more.

Assuming your father did nothing to help you out of this you shouldn't hesitate to get a lawyer and go after them for damages. Again, assuming the laws aren't fucked up where you live and all it takes is the word of a psychotic to make an arrest, I'd also sue the Deputy and the Sherrif's Department he works for for arresting you without any evidence or proof you did anything she accused you of.

Also. when you can make it home again, be sure to document any damage or anything that may be missing.

I agree, but you cant squeeze water from a rock.

I have been in a lawsuit twice. Even if you win you still have to collect.

Then you spend more trying to collect. Unless you sue someone with money, like the sherrifs and they settle with you.

Of course...I have to win first. Otherwise I won't be able to do anything. If I lose, that makes them right.

Not necessarily. Civil proceedings can and do have different outcomes.

Just get a lawyer that only takes a percentage of the settlement for his payment.

Gives 'em an incentive to win.

Yes, I lost at least 20 pounds while I was in jail. I was so nervous it was unbelievable. Just worrying about my dog was probably 10 of those pounds.

More on this. The other times she accused me, my father told the police that I in fact did not hit her. She got smart and told him to back her up or she would leave him. So they both told the police that I hit her. Even without evidence, I assumed that the word of 2 people (her and a supposed witness) was enough. Am I wrong here? You are right though, there was no physical evidence and the supposed events took place months before hand.

If I am missing so much as a shoelace I will charge both of them with larceny. I do suspect that some of my more valuable items such as my new computer and my mothers jewelry that she left me when she died are gone. When I can prove that, I will swear out complaints.

If I can sue the sheriffs department, I will. If I win then I will have options. At that point since it is a civil matter, lawyers will be fighting to talk to me.
